Terms of Use (EULA)

Unless stated otherwise, these Terms apply generally when using the Safe Hunt Pro application and website (the “Service”). Specific or additional conditions may apply in certain situations and will be identified where applicable.

By using the Service, you confirm that:

• You are at least 18 years old.
• You are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a country that supports terrorism.
• You are not listed on any U.S. government list of prohibited or restricted parties.
• You will not use Safe Hunt Pro to engage in criminal activity.

Account registration

To use the Service, you may be required to register or create an account using complete and truthful information. You are responsible for keeping your login details confidential and for selecting a strong password. By registering, you accept responsibility for activity under your username and password.

You must promptly contact us if you believe your personal information, account, or login details have been compromised, disclosed, or stolen.

Registration conditions

• Accounts may not be registered by bots or other automated methods.
• You may register only one account unless otherwise specified.
• Your account may not be shared with another person unless otherwise specified.

If a person under 18 creates an account by providing false birth information, that person and their parent or guardian accept responsibility for use of Safe Hunt Pro, including location sharing and interaction through a social feed that may include adults.

Location sharing and safety features

Users understand that location sharing is a central feature of Safe Hunt Pro. While using the map feature, users agree that the application may use and share their location with other Safe Hunt Pro users for safety and experience purposes. User locations are visible only within Safe Hunt Pro, except in the circumstances described below.

Location visibility is limited to an approximately 0.5-mile map radius. A user outside that radius will not be visible. A user’s location may be available while that user is actively using the Safe Hunt Pro map feature.

If we reasonably determine that a user is engaging in criminal activity, the user’s location may be preserved or shared with appropriate external agencies as permitted or required by law to help prevent or investigate that activity. If we reasonably believe a user is in danger and requires emergency assistance, we may cooperate with law enforcement, emergency services, or other appropriate agencies to help locate that user.

Safe Hunt Pro is designed to enhance outdoor safety and experience; it is not a replacement for sound judgment, situational awareness, emergency preparation, or compliance with applicable law. Users accept responsibility for how they use the Service and agree that any waiver or limitation of claims applies only to the fullest extent allowed by law and does not apply where liability cannot legally be waived, including proven gross negligence where applicable.

Hunting regulations and user content

Users must follow all applicable state and local hunting, weapons, trespass, and outdoor regulations. Safe Hunt Pro is an outdoor safety and social-connection application. State-specific rules should be confirmed through the relevant official state resources.

The social feed may be visible to all Safe Hunt Pro users. Content may involve outdoor experiences, animals, firearms, weapons, and hunting imagery. We may remove posts that violate these Terms or our standards and may restrict or block a user’s social features for repeated violations.

Account termination, suspension, and deletion

You may close your account and stop using the Service at any time by following the instructions on our Account Deletion page or contacting us.

We may suspend or terminate the Service or your access, with or without prior notice and to the extent permitted by law, if you breach an agreement with us, if we reasonably believe there has been a security breach or unauthorized account activity, or for other legitimate operational or safety reasons.

Suspension or deletion of an account does not create a right to compensation, damages, or reimbursement. Suspension or deletion for reasons attributable to the user does not relieve the user of amounts already owed.

Safe Hunt Pro does not tolerate and may remove content, restrict features, or terminate accounts for:

• Hate speech directed at another user;
• Threats against another user;
• Deception or scams;
• Illegal, dangerous, abusive, or otherwise inappropriate activity involving Safe Hunt Pro.

Content and intellectual property

Unless otherwise stated, content within the Service is owned or provided by Safe Hunt, LLC or its licensors. We work to ensure that content complies with applicable law and third-party rights, but errors may occur. If you believe content infringes your rights, contact us using the information above.

If content reported through a part of the Service available through an app store is determined to be objectionable or in violation of these Terms, we may remove it and restrict the person who submitted it from using the Service.

All intellectual and industrial property rights relating to the application—including copyrights, trademarks, patents, designs, software, technical features, trade names, service marks, illustrations, images, and logos—remain the exclusive property of Safe Hunt, LLC or its licensors and are protected by applicable law and international treaties.

External resources

The Service may provide access to third-party resources. We do not control those resources and are not responsible for their content or availability. Any rights or conditions relating to third-party resources are governed by the provider’s terms and applicable law.

Acceptable use

You may use the Service only as intended, in accordance with these Terms and applicable law. You are responsible for ensuring your use does not violate laws, regulations, or third-party rights.

We may deny access, terminate agreements, preserve evidence, or report conduct to appropriate authorities if we reasonably believe a user is violating law or these Terms, infringing third-party rights, significantly harming our legitimate interests, or endangering Safe Hunt, LLC, another user, or a third party.

Software license

Subject to compliance with these Terms, Safe Hunt, LLC grants you a revocable, non-exclusive, non-sublicensable, and non-transferable license to use the software and technical features of Safe Hunt Pro for their intended purposes.

This license does not permit access to, use of, or distribution of source code. The techniques, algorithms, procedures, and related documentation remain the property of Safe Hunt, LLC or its licensors. All rights and licenses end when this agreement terminates or expires.

You may install and use the application on multiple ordinary, supported devices. We may release updates or improvements, and an update may be required to continue using the Service. A substantially new version or release may require a separate purchase or license. When the license ends, you agree to delete copies of the software in your possession or control.

The licensed software is intended to remain functional during an active subscription, subject to required updates and these Terms. Software can contain errors and experience occasional technical faults. To the extent required by law or agreement, we will work to address defects that materially impair functionality, except where a defect results from improper use or failure to install a required update.

Purchases and subscriptions

Safe Hunt Pro or products offered through it may be purchased through the Apple App Store, Google Play, or the Safe Hunt Pro website. App-store purchases are also subject to the relevant store’s terms, which control in the event of a conflict regarding that store transaction.

Subscriptions provide access to applicable products or features over time and may be billed monthly. If payment is not received, access may be paused, suspended, or terminated.

Apple App Store and Google Play subscriptions

When subscribing through Apple or Google, you acknowledge that:

• Payment will be charged through the applicable Apple ID or Google Play account.
• The subscription automatically renews for the same duration unless canceled at least 24 hours before the current period ends.
• Renewal charges may be processed within 24 hours before the end of the current period.
• You can manage or cancel the subscription in the applicable app-store account settings.

These app-store terms control over conflicting subscription provisions in this document.

Termination and refunds

You may terminate a subscription at any time using the applicable purchase channel. If the subscription period has already been billed, no refund will be provided except where required by law or the applicable store’s rules. Cancellation stops future renewals.

Liability and indemnification

Indemnification

To the extent allowed by law, you agree to defend, indemnify, and hold harmless Safe Hunt, LLC and its affiliates, officers, directors, agents, partners, suppliers, and employees from third-party claims, damages, losses, liabilities, costs, or expenses—including reasonable legal fees—arising from your use of the Service; data or content you send or receive; your violation of these Terms, third-party rights, or applicable law; content submitted through your account; misleading, false, or inaccurate information; intentional misconduct; or culpable conduct by you.

If negligence, improper use, or a violation of these Terms by a user is proven, that user remains responsible to the extent permitted by law.

General limitation of liability

To the fullest extent permitted by law, Safe Hunt, LLC limits its liability for damages arising from agreements with you or your use of the Service. Limitations do not apply where prohibited by law, including certain damages affecting life, health, or physical integrity; breach of essential contractual obligations; or intentional misconduct or gross negligence.

Where liability cannot be excluded but may be limited, liability is limited to typical and reasonably foreseeable damages. Injury, loss, or damage caused by another user’s mistake, misuse, negligence, or unlawful conduct is the responsibility of that user to the extent permitted by law.

U.S. users: disclaimer of warranties

The Service is provided on an “as is” and “as available” basis and is used at your own risk. To the maximum extent permitted by law, Safe Hunt, LLC disclaims express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the Service will always be accurate, meet every requirement, remain uninterrupted, be available in all locations or on every device, or be free from bugs, viruses, harmful components, cellular-service interruptions, or other faults. Information obtained through the Service does not create a warranty not expressly stated here. Content downloaded through the Service is obtained at your own risk.

We do not endorse or guarantee third-party products or services advertised through or linked from the Service and are not responsible for transactions between users and third-party providers.

Some jurisdictions provide rights that cannot be waived and may not permit certain warranty exclusions. These provisions apply only to the extent permitted by applicable law.

U.S. users: additional limitation of liability

To the maximum extent permitted by applicable law, Safe Hunt, LLC and its subsidiaries, affiliates, officers, directors, agents, partners, suppliers, and employees will not be liable for indirect, punitive, incidental, special, consequential, or exemplary damages, including loss of profits, goodwill, use, data, or other intangible losses, arising from or relating to:

• Use of or inability to use the Service;
• Hacking, tampering, or unauthorized access to an account or information;
• Errors, mistakes, or inaccuracies in content;
• Personal injury or property damage arising from use of the Service;
• Unauthorized access to secure servers or stored personal information;
• Interrupted or stopped transmission to or from the Service;
• Bugs, viruses, Trojan horses, or similar harmful elements;
• Errors or omissions in content; or
• Defamatory, offensive, illegal, or otherwise wrongful conduct by a user or third party.

Where permitted, total liability is limited to the amount you paid Safe Hunt, LLC during the 12 months preceding the event giving rise to the claim or during the term of your agreement, whichever period is shorter. These limitations apply regardless of the legal theory asserted and even if the possibility of damage was disclosed.

Some jurisdictions do not permit exclusion or limitation of incidental or consequential damages. You may have legal rights that vary by jurisdiction, and these limitations apply only to the extent allowed by law.

No waiver

Failure to enforce a right or provision does not waive that right or provision. A waiver in one instance is not a continuing waiver.

Service interruption and discontinuation

We may interrupt the Service for maintenance, updates, or other changes, with appropriate notice where practicable. The Service may also be unavailable because of circumstances beyond our reasonable control, such as infrastructure failures, network interruptions, or blackouts.

We may suspend or discontinue the Service within applicable legal limits. If the Service is discontinued, we will handle personal data and any continuing rights as required by applicable law.

No resale

You may not reproduce, duplicate, copy, sell, resell, or exploit any part of the Service without our express written permission or authorization through a legitimate resale program.

Privacy

Our collection and use of personal data are described in the Safe Hunt Pro Privacy Policy.

Changes to these Terms

We may modify these Terms and will provide notice as required by law. Changes apply from the communicated effective date forward. Continued use after the effective date signifies acceptance. If you do not agree, you must stop using the Service and terminate the agreement.

The prior version governs the relationship before acceptance of the new version. You may request a previous version from us. Where required by law, we will provide advance notice of the date changes take effect.

Assignment

We may transfer, assign, dispose of by novation, or subcontract rights or obligations under these Terms while considering your legitimate interests. You may not assign or transfer your rights or obligations without our written permission.

Severability

If any provision is invalid or unenforceable, the remaining provisions remain in effect. For U.S. users, an invalid provision will be interpreted or narrowed as reasonably necessary to make it valid and consistent with its original intent. These Terms constitute the entire agreement concerning their subject matter and supersede earlier communications to the fullest extent permitted by law.

For EU users, if a provision is void, invalid, or unenforceable, the parties will attempt in good faith to identify a valid replacement. If they cannot, applicable statutory provisions will replace it. Severance will not preserve the agreement where the affected provision is essential or where doing so would create unacceptable hardship.

Governing law and jurisdiction

These Terms are governed by the laws of the State of Arkansas and applicable United States law, without regard to conflict-of-law rules. If the law where you live provides higher mandatory consumer protection, those protections apply.

To the extent permitted by law, courts located in Arkansas have jurisdiction over disputes related to these Terms. This does not override mandatory rights of consumers in the European Union, United Kingdom, Switzerland, Norway, Iceland, or another jurisdiction that does not permit this choice.

Consumers in England and Wales may bring proceedings in English and Welsh courts. Consumers in Scotland may bring proceedings in Scottish or English courts. Consumers in Northern Ireland may bring proceedings in Northern Irish or English courts.

U.S. users: jury and class-action waiver

To the extent permitted by law, each party waives the right to a jury trial in connection with disputes arising from these Terms. Claims must proceed individually, and neither party will participate in a class action or other representative proceeding concerning such a claim.

Surviving provisions

Provisions that by their nature should survive termination will remain effective, including license restrictions, indemnification obligations, warranty disclaimers, and liability limitations. User license grants stated as surviving indefinitely will do so; indemnification obligations survive for five years from termination; warranty disclaimers and liability limitations survive indefinitely, in each case to the extent permitted by law.

Safety disclosure

Safe Hunt Pro was designed to improve safety and outdoor experience. Outdoor conditions, device accuracy, cellular coverage, battery life, user behavior, map data, weather, terrain, and other variables can affect the Service. Every user must continue to use safe and lawful practices and exercise independent judgment while hunting or participating in outdoor activities.
